Code of Ethics for Therapists on the Awakya Platform

I. General Provisions

1.1. This Code sets out the ethical rules and standards of conduct that must be observed by Therapists using the online Awakya Platform.

1.2. Awakya is a professional online platform for holistic practices, personal and spiritual development (available on the Website), which connects Users with Therapists, with Accommodation Venues and Events, and with Events organised in connection with the Services they offer ("Platform"), and which is managed by the Operator.

1.3. This Code is aligned with the Health Act, the Consumer Protection Act, the Copyright and Neighbouring Rights Act, the General Data Protection Regulation (GDPR), the Protection Against Discrimination Act, Ordinance No. 7 of 1 March 2005 on the requirements for the activities of persons practising non-conventional methods for beneficial impact on individual health (Ordinance No. 7), as well as other relevant legal acts.

1.4. This Code of Ethics enters into force with respect to the Therapist from the moment they register their Profile on the Platform. By registering on the Platform as a Therapist, you declare that you are familiar with this Code of Ethics.

1.5. When providing the Services, the Therapist shall be guided by the principles of good faith, professionalism, confidentiality, transparency, and responsibility.

II. Competence and Qualification

2.1. The Therapist shall provide services only within the scope of their competence, experience, and professional training, and must be aware of the limits of their specific skills and the limitations of their expertise, while complying with the requirements for carrying out effective professional activity.

2.3. The Therapist may apply only methods for which they possess professional qualification, positive practical experience in their use, and where there is no evidence of harmful effects related to the application of the respective method.

2.4. The Therapist undertakes to keep their knowledge and skills up to date through training, professional development, and the exchange of good practices.

III. Relations with Users

3.1. The Therapist is obliged to treat the Users who seek their assistance through the Platform with respect, responsibility, and integrity, and to acknowledge their individuality, needs, and problems (including health-related issues), without any discrimination on the basis of age, gender, ethnicity, religion, health status, sexual orientation, or beliefs.

3.2. Any form of physical, verbal, psychological, or spiritual influence that violates the User's personal boundaries or dignity is strictly prohibited.

3.3. All Therapeutic Services must be aimed at supporting the User's personal wellbeing and balance, and must not be presented as a form of medical diagnosis, treatment, or medical consultation.

3.4. The Therapist may not use the User's dependency or trust for personal, material, or professional benefit.

3.5. The Therapist must not mislead the User regarding the potential impact of the (non-conventional) method on their health condition.

3.6. The Therapist is not permitted to perform activities that constitute diagnosis, treatment requiring medical qualification, prescribing medication, or advising against seeking medical help.

3.7. The Therapist is not allowed to offer treatment or conduct consultations with individuals in a suicidal crisis.

3.8. The Therapist must not allow the deterioration or harm of the User's health condition (physical or mental) when the User has sought their assistance through the Platform.

3.9. The Therapist is prohibited from exercising any form of pressure, manipulation, or the use of fear or guilt to induce the User to request additional services.

3.10. A Therapist practising non-conventional methods is required to periodically and in due time monitor changes in the health condition of the User to whom these methods have been applied. Upon establishing any negative effect on the User's individual health resulting from the application of the non-conventional method, the Therapist must immediately discontinue its use and promptly notify:

  • 3.10.1. all persons on whom the method has been applied;
  • 3.10.2. the User's chosen general practitioner; and
  • 3.10.3. the Director of the Regional Health Inspectorate (RHI).

3.11. A Therapist practising non-conventional methods must recommend consultation with medical institutions in cases of deterioration in the User's health condition.

3.12. A Therapist practising non-conventional methods must immediately notify the User's chosen general practitioner or the emergency medical service when the User's condition requires immediate medical intervention.

3.13. The Therapist is not allowed to use methods of influence that may cause pain, discomfort, psychological problems, or methods that violate good morals.

3.14. A Therapist practising non-conventional methods is not permitted to use invasive methods, except acupuncture, as well as methods whose application poses a risk to the health condition of the User who sought their assistance.

3.15. The Therapist is obliged to encourage and maintain high standards of professional activity and organise their work in accordance with this Code of Ethics.

3.16. The Therapist is not allowed to use their professional relationship with the User as a basis for future personal, religious, commercial, political, or other ideological interests.

IV. Content and Publications in the Therapist's Profile on the Platform

4.1. The Therapist may publish in their Profile materials (texts, photos, videos, etc.) that constitute their own original content or for which rights have been duly secured, and which do not contradict applicable legal requirements.

4.2. The Therapist is required to indicate clearly in their Profile that they do not provide medical services, medical consultations, or medical activities within the meaning of the Health Act, the Medical Establishments Act, and other healthcare legislation, as well as that they do not perform emergency medical assistance within the meaning of Ordinance No. 25 of 4 November 1999 on the provision of emergency medical care.

4.3. The Therapist undertakes to present their services in an accurate, transparent, and unambiguous manner, without using misleading statements or promises of guaranteed results.

4.4. The Therapist is responsible for the lawfulness, accuracy, and impact of the content they publish in their Profile.

4.5. The use of medical terminology, diagnoses, or claims that a particular service "treats," "cures," or "prevents disease" is prohibited.

4.6. The Therapist must not publish content in their Profile that misleads Users or contains statements such as (including but not limited to):

  • "I treat depression"
  • "I eliminate panic attacks"
  • "I cure/clear autoimmune diseases"
  • "I clear karma and illnesses"
  • "Guaranteed result after one session"
  • "If you don't do …, you will get sick"
  • "I will tell you what will happen next month"
  • "I will bring your partner back within 3 days with a ritual"
  • and other similar formulations.

4.7. The following types of wording are permitted:

  • "I support the process of emotional release"
  • "I work to energetically harmonise the system"
  • "I create a safe space for awareness and transformation"
  • "I support the client's inner resources to cope with …"
  • "I work with archetypes through tarot for inner awareness"
  • "I offer regression practice for exploring subconscious patterns"

4.8. A Therapist practising non-conventional methods is not allowed to publish in their Profile advertisements for Non-Conventional Methods or for activities related to their application, including associating them with prevention, diagnosis, treatment, or rehabilitation.

4.9. The Therapist must apply their Services with a consciously framed message, and tools such as tarot cards, regression, astrology, radiesthesia, and other intuitive methods may be used only with a clearly stated description that they support self-awareness.

4.10. When the Operator identifies a violation of the rules under this Section 4 by a Therapist, the Operator has the right to delete the respective content from the Therapist's Profile. In cases of systematic violations (more than two violations within one year), the Operator has the right to delete the Therapist's Profile.

4.11. The Therapist is not permitted to use their Profile to promote religious beliefs, moral doctrines, or discriminatory statements, including but not limited to those related to gender, race, religion, sexuality, or cultural identity.

V. Confidentiality and Personal Data Protection

5.1. The Therapist is obliged to keep confidential, and not to share, publish, or disclose any information entrusted by a User, unless there is explicit written consent from the User or a legal basis for doing so.

5.2. Confidentiality applies to personal data as well as to emotional, spiritual, or psychological aspects shared during the therapeutic process.

5.3. All data collected must be used in accordance with all personal data protection standards under Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, as well as in accordance with the Platform's General Data Protection Policy.

VI. Professional Conduct

6.1. The Therapist shall maintain respectful and professional communication with Users, other Therapists, Accommodation Venues and event organisers, and representatives of the Operator.

6.2. The Therapist is prohibited from using hate speech, threats, indecent, or aggressive behaviour.

6.3. The Therapist may not perform services while under the influence of alcohol, narcotics, or psychoactive substances.

6.4. The Therapist is required to ensure a safe, calm, and appropriate environment for conducting sessions — both online and in-person.

VII. Conflict of Interest

7.1. The Therapist must avoid situations that may lead to a conflict between their personal interests and the interests of the User or the Operator.

7.2. In the event of a potential conflict, the Therapist must immediately inform the Operator and, if necessary, terminate the relevant relationship.

VIII. Violations and Consequences

8.1. A violation of the provisions of this Ethical Code may result in temporary restriction, suspension, or permanent termination of the Therapist's access to the Platform.

8.2. Therapists bear full responsibility for any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to the Services they offer, including but not limited to claims of infringement of intellectual property rights.

8.3. The Operator shall not be liable to the Users for any claims, direct or indirect damages, or consequences arising from the use of the Services offered by the Therapists, as well as from the content published on the Therapist's Profile.

IX. Amendments to the Code

9.1. The Ethical Code may be amended by the Operator at any time. The Operator shall notify the Therapist of any changes by sending an email to the address used for registration on the Platform, granting a period for reviewing the amendments. If the Therapist does not object within the specified period, the amendments shall be deemed accepted.

9.2. If the Therapist disagrees with specific amendments to the Ethical Code, they may express such disagreement within the period under Art. 9.1. by sending a notice to the Operator stating that they reject the changes. This will result in the automatic termination of the Agreement between the Therapist and the Operator, as well as the deletion of the Therapist's Profile.
